Lawsuit Against OpenAI
Mayes filed an 87-page lawsuit against OpenAI in Maricopa County Superior Court, as reported by USA Today. The lawsuit alleges that OpenAI committed widespread violations of the Arizona Consumer Fraud Act and says its chatbot exposes minors in Arizona to a range of serious harms that the company failed to disclose, according to KJZZ.
Mayes stated that OpenAI designed its chatbot to attract young users and keep them engaged to capture personal data for commercial benefit, according to KVOA. Mayes also attributed seven rogue AI events between May and August to OpenAI, as reported by Courthouse News Service. Through the lawsuit, Mayes sought court orders forcing OpenAI to change how ChatGPT operates and sought to require OpenAI to pay Arizona up to $10,000 for each willful violation, according to USA Today.
Technology and Data Center Actions
Mayes called for a statewide moratorium on the construction of new data centers in Arizona, according to AZPM.
In other technology enforcement actions, Mayes filed legal action against TikTok alleging it deliberately caused Arizona teenagers to become addicted, pursued consumer fraud enforcement actions against online retail companies Amazon and Temu, and participated with 46 other state attorneys general in negotiating a settlement with Meta Platforms Inc., according to Courthouse News Service.
Antitrust and Consumer Enforcement
Mayes sued nine major landlords for allegedly colluding to raise rental prices, took action to block the Kroger-Albertsons supermarket merger, and sued MultiPlan and major health insurers over shared payment algorithms, according to AZPM.
Mayes also sued GSK over alleged conduct delaying generic alternatives for its asthma medication, opposed a 14% rate increase requested by utilities APS and TEP, and had her office intervene in the Project Blue case regarding a utility rate formula, according to AZPM.
Law Enforcement and State Governance Actions
Mayes worked with Arizona law enforcement to seize 27 million fentanyl pills, and her office indicted over 140 individuals and entities connected to a $2 billion sober living fraud scheme, according to AZPM.
Regarding federal relations, Mayes strongly disagreed with the premise that state agencies should share information about Arizona residents with federal immigration authorities, established a portal on the Attorney General's website allowing residents to report evidence of misconduct by federal agents, and declined to provide voter rolls when requested by the Department of Justice, according to AZPM.
Mayes also sued the city of Tolleson over a policy imposing a $15,000 fee on firefighters who leave within three years, requested a court order to prevent Tolleson from enforcing that policy during litigation, and argued that firefighters should not be trapped in jobs by repayment fees unrelated to actual training costs, according to KTAR.
